1. Acceptance of Terms

By downloading, installing, or using TunnelON ("the App", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and TunnelON.

2. Description of Service

TunnelON is a VPN client application that enables you to establish secure connections to VPN servers. Important clarifications about our service:

• We are a VPN CLIENT, not a VPN service provider
• We do NOT operate, manage, or provide VPN servers
• You must provide your own server configurations to use this App
• We have no control over or visibility into the servers you connect to
• The App supports multiple tunneling protocols including VLESS, VMess, Trojan, Hysteria2, SSH, and others
• We do not guarantee connectivity to any particular server or service

3. Eligibility

You must be at least 13 years old to use this App. If you are under 18 (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian to use this App. By using this App, you represent and warrant that you meet these eligibility requirements.

4. User Responsibilities

By using TunnelON, you agree to:

• Provide your own valid server configurations
• Comply with all applicable local, state, national, and international laws and regulations
• Not use the App for any illegal, harmful, or fraudulent activities
• Not attempt to interfere with or disrupt the App or servers connected through the App
• Not use the App to transmit malware, viruses, or malicious code
• Not use the App to infringe on intellectual property rights of others
• Be solely responsible for the servers you choose to connect to
• Understand that your server provider, not us, is responsible for the services they provide

5. Prohibited Activities

You agree NOT to use TunnelON for:

• Any activity that violates applicable laws in your jurisdiction
• Accessing content that is illegal in your location
• Harassment, abuse, or harm to others
• Distribution of malware or malicious software
• Unauthorized access to computer systems or networks
• Activities that could damage the reputation of TunnelON
• Any form of fraud or deceptive practices
• Circumventing digital rights management systems
• Sending spam or unsolicited communications

6. VPN Service Usage (VpnService API)

TunnelON uses the Android VpnService API and iOS Network Extension to route your device traffic through VPN connections. By using this App:

• You acknowledge that VPN functionality is the core purpose of this App
• You consent to the App creating a local VPN interface on your device
• You understand that all device traffic may be routed through your configured VPN server
• You understand that connection reliability depends on your server configurations
• All data transmitted through VPN connections is encrypted
• We do not intercept, monitor, or log any traffic passing through the VPN tunnel

7. Intellectual Property

The App, including its design, features, code, graphics, and content, is protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App without authorization
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices from the App
• Use the App's branding or trademarks without permission
• Create derivative works based on the App

8. Third-Party Services

The App may contain links to or integrate with third-party services:

• Advertisements: We display ads through Google AdMob. Your interaction with ads is governed by the advertiser's terms.
• Analytics: We use Firebase Analytics for anonymous usage statistics.
• Crash Reporting: We use Firebase Crashlytics for anonymous crash reports.
• Server Providers: Any VPN servers you connect to are provided by third parties, not by us.

We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the reliability of any VPN servers you connect to
• Warranties that the App will meet your specific requirements
• Warranties that defects will be corrected

Connection reliability, speed, and security depend entirely on the VPN servers you choose to configure and use. We have no control over third-party servers.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TUNNELON AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from your use of or inability to use the App
• Any damages resulting from unauthorized access to your data
• Any damages resulting from third-party servers you connect to
• Any damages exceeding the amount you paid for the App (if any)

11. Indemnification

You agree to indemnify, defend, and hold harmless TunnelON, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

• Your use of the App
• Your violation of these Terms
• Your violation of any law or rights of a third party
• Any content transmitted through your VPN connections
• Your server configurations or the servers you connect to

12. Account Deletion

If you have subscribed to our notification list or created any account-related data with us, you can request deletion of your data at any time by:

• Sending an email to legal@tunnelon.app with subject "Delete My Data"
• Clicking the unsubscribe link in any email we send you
• Using the unsubscribe feature on our website

We will process deletion requests within 30 days. Local data stored on your device (such as server configurations) can be deleted by uninstalling the App.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website or within the App. Your continued use of the App after changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

14. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including:

• Violation of these Terms
• Illegal activity
• At our sole discretion for any reason

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in accordance with applicable law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TunnelON regarding your use of the App, superseding any prior agreements.
